Are prediction markets legal? Is Kalshi gambling?
Short answer: they're federally regulated, and they're also being fought by a lot of states. Both things are true at once, and that's why the rules feel confusing.
Why they're allowed at all
Kalshi and Polymarket US run exchanges regulated by the CFTC, the federal agency that oversees futures markets. Under that system, a sports contract is treated like a financial product, not a bet. That's why these apps call it a trade and why Kalshi lets people 18 and older use it, while most state sportsbooks require you to be 21.
Why states push back
Most states license and tax sportsbooks. Their view is simple: if you pay money and win money on a game, that's sports betting, no matter what the app calls it. More than a dozen states have taken legal action against Kalshi over sports contracts.
What this means for you
So is it gambling?
Legally, the courts haven't finished deciding. Practically, here's my honest take. You're putting money on the outcome of a game. Size it like a bet, track it like a bet and never chase a loss because the screen looks like a stock app.
